You are well aware that, since last couple of years our organization–

Vidarbha Jan Andolan Samiti, is raising the issue of plight of poor farmers who are in extreme distress & suffering the heat of failure of Govt. policies of Liberalization / Globalization / Free Economy, which has resulted in complete collapse of Indian Rural Economy and perhaps Vidarbha Region has been branded as Epicenter of farmers suicides and is till witnessing a live lesson to learn.

From the days Your Honour occupied the Office of Prime Minister of India, we have been keeping you informed about the plight of farmers & agrarian community in Vidarbha and their distressed conditions. We have also kept Your Honour posted regularly with the facts & figures of the ruining Indian Rural Economy in the backdrop of Government Policies promoting Liberalization / Globalization / Free Economy and so called Development & Global Vision. We always prayed for your humble intervention in the interest of justice to the Project Affected Peoples-Farmers & Rural India.

Hon'ble PM Sir, with this representation, we invite your kind attention towards most serious issue of corruption & misuse of power by the high profile persons in the name of development & infrastructure building through the project like MADC's MIHAN which is being projected as so called "Global & Vision Project" of Vidarbha, an epicenter of Farmers Suicides in which thousands of farmers have killed themselves. Host of the Project Affected Persons (PAP) and Farmers have lost their lives. The information received from the inside sources is alarming and quite shocking. We want to share it with you and demand detailed CBI enquiry into the affairs of MADC's MIHAN Project and corruption-misuse of power-favoritism which caused loss of revenue to the tune of crores of rupees of the public exchequer.

Details are as under :-

i) Government of Maharashtra under the Chairmanship of Chief Minister of the State has formed a company named "Maharashtra Airport Development Authority Ltd." (MADC) under the provisions of Companies Act, 1956 in which many Government / Public Undertakings have been forced to contribute as share capital. Ex-Bureaucrat-Mr. R.C. Sinha, Retd I.A.S. was made Vice-Chairman & Managing Director of MADC with many top ranking IAS Officials were named as Directors on BOD of MADC Ltd., which started implementing big project in the name of MIHAN Near Nagpur and started projecting the said project as "Global & Vision Project" of Vidarbha.

ii) Under the disguise of Global Infrastructure Development in Vidarbha so called Vision Project-MIHAN-SEZ-HEALTH CITY-LOGISTIC TERMINAL- TOWNSHIP, ETC. were proposed by MADC Ltd.. Hundreds of Hectors of cultivatable agricultural land of poor farmers was put to an acquisition under the Land Acquisition Act. Even though, land acquisition award pertaining to entire land is yet to be passed, MADC Ltd, VC & MD Mr. Sinha started allotment & sale of prime land to the Multinational Corporates in a mysterious & hurried manner, even in pre-primary stage of the project.

iii) The Corporate-Multinational Beneficiary of such land allotment are as under :-

Reatox – 60 Hectors,

HCL – 31 Hectors,

SICOL Logistics Gupta Coal – 80 Hectors,

Ambuja Realities – 55 Hectors,

TCS – 54 Hectors,

Ascend – 60 Hectors,

iv) The bare perusal of the beneficiary reveal that the allotment has been done to the favoured without even completion of acquisition & ownership was reserved illegally without following due process of law. The irregularity were committed while allotting SEZ Land to the residential project of First City of Reatox Company, which was later disallowed by SEZ Board of Ministry of Commerce, Government of India, but the prime land was sold to many parties illegally and unauthorisedly. Even Bank Loan to the tune of crores of ruppes were raised by such companies under the disguise of ownership of land allotment by MADC. On the contrary, MADC was still to become lawful owner of the land at the time of such allotment made to the beneficiary company. This all has completed in a gross irregular manner contrary to the provisions of the MADC aims and objectives and the Rules governing disposal of land by the Government controlled companies in which Chief Minister is involved as a Chairman of MADC Ltd..

v) It is shocking to note that Sometime in 2007, MADC Vice-Chairman & MD Mr. R.C. Sinha managed to become Chairman of Maytas Company, which was promoted by one Mr. Raju, Satyam Managing Director's son. Interesting Satyam is the beneficiary of the land allotment at MADC's MIHAN Project. After becoming Chief of BOD of Maytas Company, started playing game of misuse of powers & position. On one hand Mr. Sinha was providing benefits of MADC's MIHAN Project to Corporates and on the other hand said Corporates were mysteriously giving contracts including EPC Contracts to Maytas company, for the obvious reasons.

vi) The misuse of powers and the positions at the hands of Mr. R.C. Sinha is quite interesting. For e.g. SICOL Logistics-Gupta Coal got contract for MADC's Rail & Logistic Terminal, on the other hand Maytas company got EPC Contract worth Rs. 450 Crores from Guptas. There are several examples like this. Mr. Sinha become Director on the Board of Ambuja & Indu Projects, the direct & indirect beneficiaries of MIHAN Project of MADC Ltd..

vii) Family Members, Relatives, Politicians blessed by VC & MD of MADC Ltd are the direct & indirect beneficiaries of the Corporates to whom MADC favoured at MIHAN Project either in allotment of land or otherwise. If you examine the share holders list and other business interest of these Corporates, the family members, relatives, closed friends and politicians blessed by VC & MD of MADC Ltd., you will come to know the truth.

viii) The assets & properties built by the relatives, family members, closed friends and politicians blessed by VC & MD of MADC Ltd. either in India or overseas specially in United States and Switzerland including Bank accounts in Swiss Bank will speak about amazing wealth acquired disproportionate to the known source of income directly in contravention of the provisions of Prevention of Corruption Act & other penal / criminal provisions of the Laws of the Land including violation of the provisions of Companies Act, 1956, FEMA Act and Income Tax-Wealth Tax Act.

ix) In such a way, Vice-Chairman & MD of MADC Mr. R.C. Sinha helped many corporates like Maytas company in which he was Chairman, Ambuja & others in which he or his family members, relatives, close friends were directly or indirectly involved. The misuse of position and power to give benefit and pecuniary advantages to the company in which he has direct personal interest is nothing but a matter of open corruption. The revenue loss caused to the public fund due to favouratism is a great matter of national concern.

x) The entire affairs at MADC Limited vis-à-vis advantages gained by Maytas and other beneficiary companies directly or indirectly with the influence, misuse of power & position by the person directly involved in both the entities give signals of open corruption which needs to be thoroughly probed and punished under the provisions of Laws of the Land, so that common man could not loose faith & belief in Rule of Law.

xi) Now, the root question raised in our mind that WHO IS RESPONSIBLE FOR DIRECT LOSS OF REVENUE TO THE TUNE OF CRORES OF RUPEES GOVERNMENT / PUBLIC FUNDS ? ARE THESE NOT SERIOUS CASES OF CORRUPTION & MISUSE OF POWERS BY HIGH PROFILE PERSONS LIKE SINHA ? These vital questions need to be answered by the independent enquiry

PM Sir, Vidarbha agrarian crisis coupled with gross corruption in the vision project like MIHAN is a live example of how we are proceeding in a Global Economy in which issues of Rural India, Project Affected People & Farmers have thrown to back benches.

We will be highly obliged, if you could spare few minutes to ON THE MOST SERIOUS ISSUE OF CORRUPTION & GROSS MISUSE OF POWERS BY MADC LTD VICE-CHAIRMAN & M.D. MR. R.C. We hope you will consider our request and order immediate CBI Enquiry, as the funds from Central Government and the PSU Controlled by Central Government alongwith State Undertaking are involved in the Project MIHAN of MADC Limited in which Mr. R.C. Sinha is involved. In fact, a complete white paper on the facts & figures is needed in this grave case, involving high ranking bureaucrats, politicians & big Corporates.

We also pray for personal hearing and opportunity of adducing evidence to demonstrate our case.

VJAS urged for national debate over recently-revamped Criminal Procedure Code (CrPC), which divests police of arrest powers in cases where the maximum sentence is up to seven years, became law with President Pratibha Patil finally giving her assent last week.
The presidential assent, which came nearly three weeks after the bill was sent to her after getting it passed from Parliament, has now paved the way for the government to notify it.
Once the law, CrPC (Amendment) Act 2008, becomes effective, the police, instead of arresting the accused, will be obliged to issue him/her a “notice of appearance’’ for any offence punishable with imprisonment up to
seven years. The person can be arrested only if he/she does not appear before the police in response to the notice. Seven years or less is the maximum penalty for a host of offences, including attempt to commit culpable homicide, robbery, attempt to suicide, kidnapping, voluntarily causing grievous hurt, cheating, outraging a woman’s modesty and death caused by negligence.
The radical change in the CrPC has, however, drawn flak from a number of Bar associations across the country. Lawyers—who also observed strike in various courts after the bill was passed in Parliament—argue that the amendment (in Section 41) doing away with mandatory arrest provisions would remove fear from the
minds of criminals who would misuse the provisions under the garb of personal liberty.
Under Section 41, as it originally stood, a police officer may, without an order of a magistrate and without a warrant, arrest any
person who has been concerned in any cognizabale offence.
Some chief ministers had also voiced concerns on the amendment during a conference on internal security here on January 6.
After the amendment in the CrPC
allows the police to arrest without an order from a magistrate and without a warrant a person who commits a cognizable offence “in the presence of a police officer’’. It also enables arrest of “a person who has committed a cognizable offence (punishable for a term which may be less than seven years or extend up to seven years) if there is a reasonable complaint or credible information or a reasonable suspicion and the police officer is satisfied that such arrest is necessary for proper investigation of the offence or for preventing tampering with the evidence’’.
The only additional requirement in such cases is that the police officer will have “to record his reasons’’ for making the arrest.

Now
Criminal Procedure Code (CrPC), which divests police of arrest powers in cases where the maximum sentence is up to seven years, became law with President Pratibha Patil finally giving her assent is ridiculous but till the debate is needed by human activists as we are not convinced the provision of amendments in Criminal Procedure Code (CrPC) and many us is of the opinion that criminal will use the liberty at the cost victimasation innocent victims hence it's time for parliament to repel the said amendment in CRPC.

The government's approach to the issue of farmer suicides is under the scanner once again. Ironically, this time the authority implementing the Rs 60,000-crore loan-waiver package has found that after loan waiver, the number of suicides have not gone down as much as expected.

The agrarian crisis in Vidarbha's cotton country shows little signs of abating despite what the government has called special efforts.

Latest figures show that the number of farmer suicides have not reduced as expected during the period 2007-08, since the loan waiver was announced.

The figures have come from the very agency authorised by the government to implement the loan-waiver package. Its study showed that the single biggest factor driving farmers to suicide continues to be loan burden.

The results of a government survey in May, in which over 12 lakh farmers from nearly 18 lakh respondents, spoke of distress due to indebtedness.

Experts studying this issue say they are not surprised by the findings at all.

"Not all the funds meant for farmers is necessarily going to Vidarbha alone. Also even in that case those getting access to the waiver or the benefits are not necessarily the most needy," said Dr S Parsuram, director, TISS.

Much criticism has come the government's way in the past over its handling of farmer suicides. But these latest statistics many are hoping will lead to a hardthink, on change of intervention strategies or at least in the way they are implemented.

सत्यम कंपनीचे मालक रामलिंकन राजू यांनी स्वतःच्या मालकीच्या मेटास इंप्रा या कंपनीमध्ये सात हजार कोटी रुपये वळते केले. नागपूर येथील मिहान या प्रकल्पासाठी राज्य सरकारने महाराष्ट्र एअरपोर्ट डेव्हलपमेंट कंपनी काढली आहे. त्याचे व्यवस्थापकीय संचालक आर. पी. सिन्हा आहेत. हा सारा कारभार त्यांच्याच स्वाक्षरीने झाला असून, महाराष्ट्र राज्य सरकारसुद्धा या पापाचे धनी असल्याचा आरोपही विदर्भ जनआंदोलन समितीने केला आहे.

समितीचे अध्यक्ष किशोर तिवारी यांनी राज्य सरकारचे सनदी अधिकारी आर. पी. सिन्हा यांना राजू यांच्या वादग्रस्त कंपनीचे अध्यक्ष होण्यास कोणी परवानगी दिली होती, असा सवालही त्यांनी केला आहे. त्याचप्रमाणे सिन्हा हे मिहानमध्ये आलेल्या किती कंपन्यांचे अध्यक्ष आहेत, हाही खुलासा होणे गरजेचे आहे. मिहानच्या बाजूला ज्या वसाहती येत आहेत, त्या सर्व प्रकल्प चालविणाऱ्या खासगी कंपन्यांमध्ये भागीदार असून, त्यांची सीबीआय चौकशी करण्याचीही मागणी त्यांनी केली आहे. सत्यम कॉम्प्युटरच्या स्पेशल इकॉनॉमी झोन विकसित करण्यासाठी मिहान प्रकल्पामध्ये सिन्हा ज्या कंपनीचे अध्यक्ष होते, त्या कंपनीला २०० हेक्‍टर जमीन सरकारने मातीमोल किमतीत दिली होती. या करारावर महाराष्ट्र सरकारतर्फे एअरपोर्ट विकास कंपनीतर्फे एम. डी. म्हणून सिन्हा यांनी सही केली होती. त्याचवेळेस मेटास इंप्राचे अध्यक्ष म्हणूनही त्यांनी सही केली होती, असेही विदर्भ जनआंदोलन समितीच्या प्रसिद्धिपत्रकात म्हटले आहे.

Sinha, I.A.S. presentely working as Vice Chairman & Managing Director, Maharashtra Airport Development Ltd. (MADC)Company in the ranking Addl. Chief Secretary, Govt. of Maharashtra has resigned as chairman of Maytas Infra Pvt.Ltd. as Maytas Infra is company owned by family members of Satyam Computer Services founder and ex.chairman Ramlinga Raju who has alleged to siphoned out Rs.7000 crore for real estate business and Ramalinga Raju's son Teja Raju is the vice-chairman and chief executive of Maytas Infra..

VJAS (Vidarbha Jan andolan Samiti) president Kishor Tiwari in letter to Maharashtra Chief Minister Ashok Chavan asked to arrange C.B.I. enquiry in to involvement of very senior bureaucrat working on sensitive project like MIHAN in which Maytas Infra has been given big land by Maharashtra Airport Development Ltd. (MADC) controlled by Shri. R.C. Sinha.

VJAS has objected the duel status of Shri. R.C. Sinha, as as Vice Chairman & Managing Director, Maharashtra Airport Development Ltd. (MADC) and chairman of Maytas Infra Pvt.Ltd and raised issue of legitimate permission and morality as MIHAN - Multi-modal International Cargo Hub and Airport at Nagpur is dream project of all politicians expecting creation of millions of jobs for vidarbha youths .

As fraud has been rocked in Satyam Computer Services and Maytas Infra Ltd. is closely linked with Satyam Computer Services founder and ex.-Chairman Ramalianga Raju hence role of Shri. R.C. Sinha, as as Vice Chairman & Managing Director, Maharashtra Airport Development Ltd. (MADC) and chairman of Maytas Infra Pvt.Ltd needs to be probed as it is reported that Mr Sinha came in contact with Satyam Computer Services founder and chairman B Ramalinga Raju, who holds a 36% stake in Maytas Infra, while he was serving the Andhra government.

Controversial officer, Mr Sinha is known as a strict task master there are complaints of having special benefits being given real estate companies like DLF and MANTRI in which some of local leaders are the promoters ,it is also allged that R.C.Sinha has been holding charge of chairman of many companies having projects in MIHAN,Kishor Tiwari allged.

The relief packages seem to have done a little when it comes to the farmers of Vidarbha, particularly the cotton growers.

Despite another relief package of Rs 6,208 crore announced by CM Ashok Chavan on the concluding day of the Winter Session, 12 more farmers ended their lives in last seven days.

Earlier, the state and prime minister had provided two separate relief packages of Rs 1,050 crore and Rs 3,750 crore respectively in 2006 to bail out Vidarbha farmers. However, the farmers’ suicide continued unabated in Vidarbha and around 2,000 more farmers have killed themselves because of crop failure and debts after both the packages were announced.

Kishore Tiwari of Vidarbha Janandolan Samiti, which is documenting the farmers’ suicide, alleged that most of the latest victims took the extreme step because they could not sell their raw cotton due to the closure of several centres by the state cotton marketing cooperative federation.

Nagpur: A large number of cotton procurement centres in the state have been closed leaving the farmers saddled with harvested crop waiting to sell the produce. According to the Vidarbha Jan Andolan Samiti, the collection centres were closed as the National Agricultural Marketing Federation (Nafed), has exhausted its funds earmarked for purchases this year.
Samiti president Kishore Tiwari told TOI on Wednesday that Pandharkawda and many other centres in Yavatmal were shut for last three weeks. "Farmers are in dire straits as private traders are also not coming forward to purchase because of severe recession in international market leading to big fall in cotton rates," said Tiwari. On Thursday, Samiti will demonstrate before the closed procurement centres in the region.
"At the start of the season, federation had promised to procure every single boll of cotton offered for purchase. It had also fixed 200 lakh quintals as target for collection. But after collecting less than 70 lakh quintal it has given up. Because Nafed, on whose behalf it is purchasing this year, is cash strapped and reports have appeared in media stating that Nafed has exhausted its allocated funds," said Tiwari.
"Obviously, the federation has failed to keep its word and is misleading people saying that procurement has been suspended as no space was available to stock cotton," Tiwari alleged.
He said the state should draw the Centre's attention to the serious problem of Vidarbha's distressed farmers in cotton belt and seek more funds for Nafed so that procurement resumes. VJAS has also alleged that the federation is behind schedule by over a month in paying dues to farmers.
"The farmer who soled cotton 40 days ago to the federation is receiving payment now. This is again a failure on the federation part which had promised to clear dues within a week," added Tiwari.

Yavatmal , Jan 6 The cotton growers of Pusad tehsil staged a road blockade when the Federation&aposs procurement centre denied the entry of cotton laden carts into the Ginning and Pressing factory premises.

The road blockade, which continued for two hours, disrupted the vehicular movements on the route yesterday. The issue was resolved after police intervened and Federtion allowed farmers to park their carts in the factory premises. It may be recalled that a weeks ago, the irate cotton growers have locked the employees and officers of the APMC and staged a dharna in front of the office when the latter refused to distribute the priority token to waiting farmers. NAFED and CCI have started procurement from November 3 last but stopped the process abruptly from December 27 citing the qunatity of cotton as more than the working capacity of men and machinery available at all centres. Priority tokens were distributed to cotton growers with an intension to reduce the last minute rush. However, the cotton growers are found flocking at each centre despite giving prior notice not to bring cotton till further orders or notification. PTI

Nagpur, Jan 7 : As many as ten debt-ridden farmers committed suicide
in Vidarbha region of Maharashtra in the first five days of the new
year, activists said today.

According to Vidarbha Jan Andolan Samiti (VJAS), a voluntary
organisation working among farmers in the region, those who ended
their lives included two each from Yavatmal, Amravati, Wardha and
Nagpur districts, and one each from Chandrapur and Buldhana districts.

The suicides took place immediately after the state government
announced a Rs 6,208 crore loan waiver and loan repayment discount
package for farmers, a VJAS press release said.

Over 5,000 debt-ridden farmers had committed suicide in Vidarbha in
the last three years, it added.

As even Maharashtra Govt. has assured that NAFED or CCI will buy all cotton from vidarbha growers till the last bole but the ground reality is not in line with announcement as almost all procurement centers in the cotton belt of vidarbha is now closed and most of farmers are forced to sale in distress in much more lower price than MSP .

First two days of 2009 has reported four farm suicides and victims are cotton growers of suicide prone district of prime minister relief package

In last fortnight the cotton procurement centers through out west vidarbha have been closed on technical ground and private traders have started cotton procurement below the minimum support price MSP and farmers are forced to sale the cotton at throw away price in distress sale and cotton growers are at huge losses resulting more farm suicides in vidarbha ,tiwari feared .

"If Govt. failed to procure the farmers cotton at MSP then it's move to raise the MSP would be ridiculous and will create more complications to the existing agrarian crisis ,hence VJAS have been demanding immediate opening of all procurements centers and in order to press our demand ,we are starting agtation from 8th janauary .

farmers who wants to sale their cotton will bring it to nearest closed procurement centre and will start agitation to demand open the centre and procurement by NAFED or CCI .

There are media reports that NAFED and CCI have buying aggressively in other states like A.P.,M.P. and Punjab but even after continuous farm suicides of vidarbha cotton farmers ,they have closed procurement ,kishor tiwari said.

VJAS has also demanded central intervention in order solve cotton farmers crisis in vidarbha ,tiwari added. .
